Terms and Conditions

The following terms and conditions - and the subsequent changes - apply to all our services available online through any mobile device, by email or by phone. By accessing our web site, visiting, using and / or using any of the applications available through any platform (hereinafter referred to as "Website"), and / or by completing a reservation, you agree you have read, understood and accepted the terms and conditions set out below (including the privacy statement).

These pages, content, structure and the online booking service accommodations provided through this website (the "Service") are owned, managed and offered by DayBreakHotels srl ( "DayBreakHotels", "DBH" "we", "us", "our / our" or "our / our") and they are provided for your forsonal use with no commercial purposes, governed by the terms and conditions described below.

1. Service Mission

Through this website we provide an online platform that allows all types of accommodations, advertising hotel establishments rooms and their services for booking (for daytime use) and visitors to the site to make reservations. By making a reservation through DBH, you'll establish a direct contractual relationship (binding in legal terms) with the accommodation with which the reservation was made. Because of that reservation, we will work as intermediaries between you and the accommodation, transmitting the relevant hotels/establishments with details of the reservation and sending you a confirmation email for and on behalf of the accommodation. Our site does not intend to biasly recommend or support any institution (in terms of quality, service level, classification and assignment) by their review ranking or star ranking is a classification of quality based on a variety of factors- this is solely at the discretion of previous guest reviews and agencies. Our services are available for forsonal and non-commercial use. Therefore, you may not resell, use, copy, deep-link, monitor, display, download or reproduce any content or information, software, products or services contained on our website for any business operating on a commercial or competitive purpose.

2. Prices and Best Rate Guarantee

All rates published on the DBH website are inclusive of VAT and all other taxes, unless otherwise indicated on the website or confirmation email. The prices on our site are highly competitive. However, these rates, proposed by the hotel, could lead to special restrictions and conditions, for example with regard to cancellation. Before making the reservation, carefully check the presence of conditions for the reservation, details, and rates.

We wish to offer you the lowest possible rate. If after you have booked with us, we find the hotel/service of your choice under the same booking conditions at a lower rate, we will contact you and apply the lower rate, according to the conditions specified below. We will offer you lowest price possible guaranteed on the following conditions: (1) you have an active booking on DayBreakHotels.com, (2) Please contact our customer support after the reservation is made, (3) if the lowest price is bookable online and is still valid at the time of our verification and (4) if the lowest price reflects the same booking conditions you found on DayBreakHotels.com (ie, same hotel, same room or room type, same check-in and check-out, the same conditions booking and same services included). We can not offer you the lowest price possible if one of the criteria mentioned above is not met. In any case, your reservation will remain valid, including the correlating cancellation policy. Remember that we can not guarantee you the best price if you booked on a website where you were unable to see the hotel until the reservation was confirmed, if you made the reservation with a one-time discount, loyalty points or other special promotions or awards programs.

3. Luggage Storage

3.1. Highlighted points to ensure the safety of your baggage:

In case your luggage is lost or gets damaged, your bags are insured and covered up to a maximum of €500, including the value of the bag. Payment for the service is done directly at the selected hotel. The price requested by the hotel depends on the time of deposit and pick up of your luggage. Your luggage can’t contain jewelry, money or similar valuables.

3.2. Luggage content:

Stored luggage can’t contain any of the following: Jewelry, money (cash, cards, checks), weapons, valuable documents, certificates, public or private investment offers, entry vouchers, meal vouchers and fuel vouchers, life-saving medicines, explosive substances and objects, flammable liquids, living or deceased plants and animals, perishable goods including food, narcotics. Objects illegally owned under Italian law, object of particular sentimental value, pornographic or indecent material, software containing sensitive information, technological objects (iPhone, iPad, Tablet, Pc, smartphone), political material, hazardous materials, psychotropic drugs or substances, works of art, antiques, gold and silver in any form and other precious metals.

The responsibility for the above mentioned objects lies fully on the client. DayBreakHotels and the selected hotel have the right to refuse to store luggage containing any of the above mentioned objects.

3.3. Damage or loss of luggage:

Once you have deposited your luggage at the selected hotel and are in possession of the receipt, any damage the luggage might be subject to is the responsibility of the hotel and DayBreakHotels. Once the luggage has been picked up and the collection receipt handed over, the risk mentioned above falls to the customer.

Any disputes must be sent to DayBreakHotels within a reasonable period of time, stating the error discovered by the customer. None of the parties is liable in the event of losses due to force majeure.

4. Privacy and cookies

DBH uses high ethical standards and respects your privacy. Unless required by law by the relevant jurisdiction, DBH will not disclose your name, email address and (if required) details of your credit card to third-parties without your consent. However, we reserve the right to disclose your forsonal information to our employees, subsidiaries, agents and representatives. These parties have complete confidentiality and their sole accessing purpose is to carry out their duties on our behalf, all so that you can benefit from a better service. 5. Free of charge

Our service is free. Unlike many other sites, we will not charge for the service, and you will not be charged additional costs (related to the reservation) or a booking fee. We will not charge your credit card, as you will pay directly to the hotel during your stay.

6. Credit card or bank transfer

For some of the services booked, facilities require the details of the credit card in order to secure your reservation. Therefore, we send the data of your credit card directly to the structure which the reservation was made with. To safeguard and encrypt the information on the credit card during their process, we use the "Secure Socket Layer" (SSL) technology. DBH does not accept payments on behalf of the structure.

7. Cancellation

By making a booking in a hotel, you accept and approve the relevant cancellation and no-show policy of that structure, as well as any other rules or additional terms of the structure applicable to your reservation or during your stay. This includes services and / or products offered by the structure (the rules and conditions of a structure are obtained directly from the relevant structure). The general cancellation and no-show of each structure are mentioned on our website information pages regarding the structure, during the booking procedure and / or on the booking confirmation. Before making the reservation, checking carefully the presence of such conditions in details regarding the room and rates. If you want to check or cancel your reservation, please access your confirmation email and follow the instructions, or access to the section of our website. The hotel may charge a cancellation fee in accordance with its cancellation policy and no-shows. Before you make a reservation, we advise you to read carefully the cancellation policy as it varies for each reservation package.

8. Further correspondence

By reserving a booking with DBH you consent to receive a confirmation email and a follow up email after your stay asking for a rating of the stay. In addition to email confirmation of the reservation, there are email notifications for changes or cancellation, email reminders if you have not completed your booking, communication regarding the booking (by our team or the hotel establishment), request for stay ranking evaluations and any other e-mail which you have specifically requested. We will not send other messages, alert or emails (required or not) unwarranted, unless you have not provided specific consent.

9. Ranking and Guest Reviews

The default setting for accommodations rankings on our website is 'Recommended' since we have selected each hotel/establishment with a rigorous process (this is called the "Default Ranking"). However, we also offer other types of rankings. The Default Ranking is created based on multiple criteria. The guest reviews can be done and then (a) displayed on the establishments listing to provide (future) customers your view about the level of service and the quality of the structure and (b) (wholly or partly) used and placed by DBH, in its sole discretion (eg. for reasons of marketing, promotional purposes or to improve the service), on the website or on social networking platforms on the newsletter, in case of special promotions, apps or the other of the channels owned and hosted, used or controlled by DBH. We reserve the right to edit, refuse or remove reviews at our sole discretion. The module for guest judgement must be considered a survey and does not include any (further) offer, invitation or inducement (commercial) of any kind.

10. Disclaimer and Limitation of Liability

Subject to the limitations and the details provided in the cases provided under these terms and conditions and to the extent formitted by law, we will only be liable for direct damages actually suffered, incurred or paid for while you using our services, due to a failure to observe our obligations in respect of the services that we would have to fulfill. The compensation may be up to the total cost of your reservation as set in the confirmation (a single reservation in email or a series of connected events).However, and as formitted by law, neither we nor any of our representatives, officers, employees, representatives, affiliates, subsidiaries, affiliates, partners (distribution), licensees, agents or forsons involved in the production, sponsorship, promotion or dissemination of the site and its contents, shall be liable for (i) loss or punitive, special, indirect or consequential damages, any loss of production, profit, revenue, contract, for injury or damage the good name and reputation, the loss of the right, (ii) the inadequacy of information (descriptive) of the facility (including rates, availability and ratings), made available on our Web site, (iii ) for the services rendered or the products offered by the proforty, (iv) for any damages (direct, indirect, consequential or punitive), losses or costs suffered, incurred or paid by you, following the inability or delay of our website, arising out of or related to the use, or (v) for any (forsonal) injury, death, proforty damage or other damage (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you while you were getting into, for actions (legal), errors, violations, crimes (serious), wilful misconduct, omissions, negligence, misrepresentation, or strict liability for a wrongful act attributable ( partially or totally) to the structure (its employees, directors, managers, agents, representatives or affiliated companies), including deletions (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

Unless otherwise specified, the software needed to provide our services, made available or used by our website, and the right content copyright (including copyright), the information and material on our site are the proforty of DayBreakHotels Srl, its suppliers or its provider. To the extent formitted by law, these terms and conditions, as well as the provision of our services, will be governed by and construed in accordance with Italian law and any dispute arising under these terms, the general conditions and our services will be provided only to the profor legal courts in Rome, Italy. In the event that any provision of these Terms and Conditions are invalid clauses, lose validity, is or becomes non-binding, you will continue to comply with all other provisions set out herein. In this case we will replace the clause with a clause that is valid and binding, which has an effect similar to the replaced and that you implicitly accept in respect of the content and purposes of these Terms and Conditions.
